Three distinct registrations protect your business: company name, trade name, and trademark. Having a registered company doesn't mean your brand is protected.
Did you know that Zara, technically, doesn't exist as a company?
Three names, three distinct registrations:
1️⃣ Company Name: Inditex, S.A. This is the legal name, the one that signs contracts and pays taxes. It's registered with the Commercial Registry.
2️⃣ Trade Name: how the company presents itself to the industry.
3️⃣ Trademark: ZARA. This is what you recognize on the label, the bag, in the store. It's registered with the OEPM.
The most common mistake I see: thinking that by having the company registered in the Commercial Registry, your brand is already protected. That's not the case. These are distinct registrations, in distinct bodies, with distinct protections.
Don't let someone else register your trademark while you only have your company's 'ID card'.
